Independence & Professional Conduct
01Our commitment
CAPE Advisory & Consulting Ltd. is committed to professional integrity, confidentiality and responsible advisory practice. We assess engagements for potential conflicts of interest and seek to maintain appropriate professional independence in regulatory, fiscal and dispute-related matters.
02Conflicts of interest
Before we accept an engagement we check it against the work we are already doing and the clients we already act for. Where we find a conflict we say so. Some can be managed — with the agreement of everyone concerned, and with separate teams and controls on information. Where a conflict cannot be managed properly, we decline the engagement.
03Confidentiality
What a client tells us stays with the people working on the matter. We do not discuss one client’s affairs with another, and confidentiality continues after an engagement ends.
It also governs how we describe our own work. The engagements on our Client Impact page are anonymised: they name a sector and the issue, never a client, and no figures that could identify one.
04The basis of our advice
Our advisory work is based on applicable laws, regulations, documented facts and professional analysis. We do not guarantee regulatory outcomes, and all engagements remain subject to the decisions and jurisdiction of the relevant authorities.
We give a view on the facts put in front of us and on the law as it stands. Where the position is arguable we say that too, rather than presenting one reading as the only one.
05Representation, where it is appropriate
We support businesses through show cause responses, appeal preparation and tribunal-stage proceedings. Regulatory representation and coordination is provided where professionally and legally appropriate. Where a matter calls for a role that belongs to another profession, we say so and work alongside it rather than stepping into it.
06Our advisors’ former roles
Several of our advisors held senior positions in the National Board of Revenue and its tribunals. That experience is why we can tell you how a position is likely to be read, and what evidence it will be tested against.
It does not give any client privileged access, and we never suggest that it does. Outcomes rest with the authorities, on the merits.
